Trade Marks Ordinance, 2001 on Distinctiveness

By Adil Waseem Distinctiveness in trademarks provides that any sign or any combination of signs, capable of distinguishing the goods or services of one undertaking from those of other undertakings, shall be capable of constituting a trademark. These may include, in particular, personal names, letters, numerals, figurative elements and combinations of colors as well as any combination of such signs. Andrew Inglis, Olswang defines the distinctiveness in these words, Distinctiveness in relation to trade marks refers to the capacity of the mark to distinguish the goods or services of its proprietor from the goods and services of others. The more distinctive a mark, the more likely it will be that broad rights attach to it Capable of distinguishing The capacity to distinguish goods or services is fundamental to the concept of a trade mark. Invented words and devices are generally capable of performing that function but there are some that are not either because thy are devoid of distinctive character, they consist of signs or indications that designate the kind, quality, quantity, intended purpose and so on of the goods or services concerned or because they have become customary in the current language or bona fide and established practices of the trade. However, even some of those marks of that kind can in time acquire distinctiveness through sales and advertising. The level of distinctiveness required for a distinguishing guise is higher than for a ordinary mark, therefore, there are fewer of them. Acquiring distinctiveness To acquire distinctiveness in trademark, the applicant trademarks must not devoid of any distinctive as mentioned in the clause (b) of the subsection (1) of section 14 of Trade Marks Ordinance, 2001 is related with absolute grounds for refusal of registration, trade marks which are devoid of any distinctive character; Trade Marks which are devoid of any Distinctive Character in British Sugar Plc v James Robertsons and Sons Ltd Jacob J suggested that a trade mark that is devoid of any distinctive character is the sort which cannot do the job of distinguishing without first educating the public that it is a trade mark. In this context, the Court of First Instance observed in Baby-Dry1, that the distinctive character of a sign must be assessed in relation to the goods or services in respect of which registration is claimed. The subsection 1 of section 15 of trademark Ordinance 2001 has laid down considerations for any tribunal to decide on distinctive character of trademarks, A trade mark may be limited wholly or in part to one or more specified colours, and any such limitation shall be taken into consideration by any tribunal having to decide on the distinctive character of the trade mark The section 17 of Trade Mark Ordinance, 2001 provides that a trademark is a detrimental to the distinctive character shall not be registered. The Section 84(2) reading with section 2 of THIRD SCHEDULE of trade Mark Ordinance 2001 deals with use of a domain name shall be taken as source identifier if it is used on Internet to distinguish goods or services of one undertaking from the other provided that use of a domain name as a mere distinctive reference. A mark, which is inherently not distinctive Exception to clause (b), (c) or (d) of Section 14 of trademarks Ordinance 2001 provided that a trade mark shall not be refused registration by virtue of clause (b), (c) or (d) if, before the date of application for registration, it has, in fact, acquired a distinctive character as a result of the use made of it or is a well known trade mark The Inherent distinctiveness of all the trademarks resulted in part from its statutory right. A mark not distinctive (e.g. descriptive) may acquire distinctiveness through use. The distinctiveness of Trade Marks as a series The clause (c) of subsection 3 of section 20 of trade Mark Ordinance, 2001 other matter of a non-distinctive character added as part of trade mark series, if any, shall not affect the identity and distinctiveness of the trade marks, provided non-distinctive character which does not substantially affect the identity of the trade mark. The affect of lose of distinctiveness The subsection 2 of section 73 of trade Mark Ordinance, 2001 for the purposes of the registration of a Trade Mark may be revoked, if use of a trade mark shall include use in a form differing in elements which do not alter the distinctive character of the mark in the form in which it was registered. A new interpretation of the distinctiveness of a Trade Mark Many national authorities that symbol comprising two non-distinctive words were non-distinctive and ineligible for registration. The BABY-DRY 1 judgment seemed to change this interpretation. It was the view that an assessment of distinctiveness must consider whether the word combination in question is understood in ordinary-language use as a normal way to refer to the goods in question or represents their essential characteristics in common parlance. Conclusion A trade mark shall not be registered unless it contains or consists of at distinctiveness, the name of a company, individual, or firm, represented in a special or particular manner; one or more invented distinctive words; one or more words having no direct reference to the distinct character or quality of the goods, and not being according to its ordinary signification, a geographical name or surname or the name of a sect, caste or tribe in Pakistan; any other distinctive mark, provided that a name, signature, or any word, other than such as fall within the descriptions in the above clauses, shall not be registered except upon evidence of its distinctiveness. When Interactive Media Induces Future Shock

By Paul R Grant It is not easy to stay abreast of all that is possible using interactive marketing. Indeed there is a delicate balance between using a state-of-the-art or cutting-edge technology and actually having the customer embrace it. Even if they do adopt the idea, there are no guarantees that a futuristic initiative will be profitable. Consider some of the pioneers of mobile phone marketing. They were creating wonderful solutions as much as five years ago, but the timing was not right. They were ahead of their time, ahead of the trend wave. Whilst they may have had the industry rags talking and quoting, the customers themselves were not ready to adopt the concept and the ideas became (at that time) economically unviable. However in 2006 the same mobile phone applications and capabilities are all the rage. Some analysts are actually predicting that customers are now waning in their interest in using multimedia mobile applications and the game is over [This is probably not true, as when Thomas Watson, chairman of IBM in 1943 said "I think there is a world market for maybe five computers."] Surfing a wave is a tricky business. It is all about timing. If you are ahead of the wave it may end up crashing down on top of you or wiping you out. If you are behind the wave you will have to paddle twice as hard as everyone else to get to the same place, and even then there is a chance you will lose momentum and not be able to capitalise on the opportunity. Of course, if you can look at all the signs and make an educated decision about when to join in on the foray, you can enjoy the ride all the way to the shore with relatively little effort. This rather simplistic anecdote illustrates the principal of the markets threshold for adoption, or willingness to uptake on a concept that was previously unfamiliar to them. In the last century the technological advancement waves have become bigger, faster, and with fewer intervals in between each. Especially when we consider that around 100 years ago people used horses and carts to travel. Future-shock is a concept devised by Alvin Toffler and propagated by the great Richard Feynman. They described prophetically in the 1970s that a time would come when people would no longer have their broken products repaired, they would simply replace them (think toaster, hairdryer etc). Feynman also predicted that one day the rise in technological advancement would so far surpass the ability of the ordinary consumer to adopt and accept these technologies that they would become paralysed with anxiety. They would not want to buy anything, because they knew that it was already out-of-date the moment they took it out of the shop (think computers). One day, he predicted, there will be a kind of future-shock where the possibilities of the future overwhelm the people in the present. Many executives have a great number of years experience, business acumen and a wealth of knowledge and yet are now also feeling this future shock. Perhaps we have all felt the future-shock to some extent. It could be that the only notable exceptions are the youngest generation that are seemingly born with a gaming console in their hands, or the innovation-hungry futurists who make a living by spouting about future possibilities. The implication of this Future Shock in the real business world is that the executive boardroom is increasingly unable to make appropriate strategic decisions that may steer the organisation through such uncharted waters as IPTV, viral marketing, social networking, PPC, RSS, Blogs, Vlogs and Podcasts to name but a few. On the one hand these leaders are desperate to maintain calm and gain a competitive edge, whilst on the other they are petrified as to how they can possibly assimilate all the new jargon and user skills that tech-savvy consumers are now all too familiar with. The most astute executives are finding specialist advisors to head up their emerging media or integrated marketing campaigns. Even Rupert Murdoch, the grand newspaperman of NewsCorp, can thank his son who has led him and educated him in the possibilities of businesses such as MySpace. Indeed, it is often ironically retired individuals or stay-at-home parents, no longer busy captaining a company or punching in their timecards, who are finding the time to actually use the newest breed of web 2.0 applications. Consider Geriatric1927, a retired gentleman who shot to fame by creating a YouTube video channel of his own rambling monologues. His notoriety was splashed all over the press, and many web users simply had to get their fix of the latest episode. It is this sort of unpredictable grass-roots activity that has caught so many strategic or traditional thinkers off guard. There is no immediate training available, no aged experts, no guaranteed resultsjust many a quick-fix book or online article full of all too pompous post-success hindsight. In spite of all this, some of the more adventurous company directors are calling in everyone and anyone that can help them to raise the awareness of the companys executive team, to workshop through and develop a carefully considered brand interactive strategy that might exploit these new forms of customer interaction. Rather than looking to imitate someone elses success, they are planning how they themselves might be the pioneers of the next movement or trend. This takes risk, planning, and sometimes compromise of the long-standing corporate directives and values that would in the past offer some semblance of security and stability. Now it is truly anyones game. It is no longer about who has the biggest media spend in television or film. Indeed many customers are now less influenced by advertising than ever before. No, it is the really innovative companies that are gaining market shareand quickly. They are developing their own brand interactive strategy, and seeing their organisational culture change through its implementation. Unquestionably, those who do take the chance are reaping the rewards. Rewards in the form of publicity, brand awareness, additional sales, brand loyalty, respect…but most importantly of all return on investment and increased profitability. Therefore any initiative that a company undertakes needs to be sensitive to both the customers and the organisations threshold for technology adoption. In this way future shock can be avoided, but let that not stop a brand from catching the waves of innovation. Find A Wedding Invitation That Is As Unique As You Are As A Couple

By Susan Ryder When we got married over nineteen years ago, my husband and I wanted to make our wedding as special and unique as we were as a couple. We not only wanted it to be a day that we would remember always, but one that our guests would also talk about for years. So we put a lot of time, thought, and energy into everything about our big day, including pre-wedding and post-wedding activities. (Well to be honest, I did most of the work, but he was a good sport, and like it or not, he had input on all of our decisions!) One of the first things we did (after we booked the church, minister, reception hall, and photographer) was to decide on wedding invitations. We went to a local print shop to look at their scrapbooks of possible invitations. But nothing there grabbed me so we went to another print shop, and another. I began to get very discouraged, and worried. How would we ever find just the right invitation? While the invitations we saw in the scrapbooks were fine, I knew theyd already been chosen by hundreds of couples before us. And they just didnt suit us as a couple. They were traditional and somewhat boring something I didnt think we were! What we wanted was something that would truly be one of a kind, and reflect our personalities and commitment as a couple. Just when Id about given up hope, my mother told us about a friend who designed her own note cards and did graphic design. My mother wrote the copy for the note cards, and wondered if maybe her friend would be interested in doing our invitations. Mom arranged for us to meet with her about doing our invitations though her friend had never done wedding invitations before, she was interested in trying. We met with her about nine months before our wedding to talk about what we wanted. We knew we wanted the invitations to match the colors of our wedding (lavender and silver) and we wanted to write our own wording on them. We also wanted a unique design on the front (our invitations folded in half) so she created several designs for us to choose from. We also were given several choices of fonts, types of paper, envelopes, and response cards. Our next visit with her included several choices of invitations that she had mocked up after talking to us about what we wanted. We were thrilled with all of them, and actually had a difficult time choosing which one we liked best, which was a wonderful position to be in! In the end we both gravitated toward one invitation fortunately it was the same one that we both loved best. And she then got to work on ordering them mass produced invitations, envelopes, response cards, more envelopes. She even did the invitation for our wedding shower, which matched the overall theme of the wedding invitations. She made about a dozen extra invitation sets for us as a keepsake, which I keep in a box in my cedar chest to this day. I keep one set in our wedding album, and I like to take it out occasionally to look at, usually after Ive received a run of the mill invitation in the mail to someone elses wedding so I can compare them. And every time I look at them I smile, and wonderful memories are called to mind. All these years later, it’s much easier to have wedding invitations designed specially for you, as there are many more professionals who are in business to create them. It may take some time, effort, and extra expense, but Ive never regretted having invitations personally made for my wedding. Its definitely worth considering! Susan Ryder is a pastor and author.
